1. Who you are contracting with
LabourLedger is operated by CYCS ("CYCS", "we", "us"). By creating an account or using LabourLedger you enter into a binding agreement with CYCS. If you use the service on behalf of a company, you confirm you have authority to bind that company; if you use it as an individual, you confirm you are of legal age.
2. Acceptance of these terms
By registering for, accessing or continuing to use LabourLedger you agree to these terms. If you do not agree, you must stop using the service.
3. The service
LabourLedger lets construction companies register projects and workers, assign crews with defined working hours, log daily hours and overtime, and export month-end payroll data. Access is provided under the plan and quantity of project slots and user seats you hold.
4. Acceptable use
You must not misuse the service. In particular, you must not:
- use LabourLedger for any unlawful purpose or in breach of applicable employment, payroll or data protection law;
- commit fraud, send spam, or submit knowingly false payroll records;
- infringe the intellectual property or privacy rights of others;
- upload malware, probe, scan, scrape or otherwise interfere with the security or integrity of the service;
- reverse engineer, resell, redistribute the service or circumvent technical or plan limits.
You are responsible for keeping your account credentials confidential, for all activity under your account, and for the accuracy of the worker, hours and rate data you enter.
5. Your data
You retain ownership of the data you enter. You grant CyCS a limited licence to host and process that data solely to provide and support the service. Our handling of personal data is described in our Privacy Notice.
6. Intellectual property
CYCS retains all rights in LabourLedger, including its software, documentation, design and branding. You receive a limited, non-exclusive, non-transferable right to use the service within the plan you have purchased.
7. Service level and warranties
We work to keep LabourLedger available and accurate, but we do not guarantee uninterrupted or error-free operation. To the fullest extent permitted by law, all implied warranties, including merchantability and fitness for a particular purpose, are disclaimed. Payroll figures produced by the service are calculated from the data you enter and must be reviewed by you before use.
8. Payment and subscription terms
Project slots and user seats are sold on a yearly term as set out on our Pricing page. Payment, billing, currency, taxes, invoicing, cancellation and refund mechanics are handled by our reseller Paddle and are governed by the Paddle Buyer Terms. Subscriptions renew yearly unless cancelled before the renewal date. When a project term expires, the project becomes read-only until renewed.
9. Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
10. Suspension and termination
We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the service at any time. On termination you may export your data for 30 days, after which it may be deleted.
11. Liability
To the extent permitted by law, our aggregate liability is limited to the fees you paid in the 12 months before the claim. We exclude liability for indirect, consequential or special damages, including loss of profits, data or goodwill. Nothing limits liability for fraud, death or personal injury caused by negligence, or any liability that cannot be excluded by law.
12. Indemnity, law and changes
You indemnify CyCS against claims arising from your data, your unlawful use of the service, or your breach of these terms. These terms are governed by the laws of the Republic of Cyprus and the courts of Cyprus have jurisdiction. We may update these terms; material changes will be notified in-app or by email. Neither party is liable for delays caused by events beyond its reasonable control.
